"fdesign-net" Client Agreement

This agreement is made between fdesign-net, managed by Mary Frost, 7 Bernham Close, Bury St Edmunds, Suffolk,
IP32 7DL and the Client …………………………………of …………………………………………………("you")

1. DEFINITIONS

"Services" means domain name registration, web site hosting, updating and any other service or facility provided by us to you. "Server" means the computer server equipment operated by our designated Internet Service Provider(s) and our chosen domain registration company in connection with the provision of the Service. "Web Site" means the area on our web space, allocated by our Server, that we have designated to host your site and administrate for you.

2. DOMAIN NAME REGISTRATION (from terms of business of our Server)

2.1 We make no representation that the domain name you wish to register is capable of being registered by or for you or that it will be registered in your name. You should therefore not assume registration of your requested domain name(s) until you have been notified that it has or they have been registered. Any action taken by you before such notification is at your risk.

2.2 The registration and use of your domain name is subject to the terms and conditions of use applied by the relevant naming authority. You shall ensure that you are aware of those terms and conditions and that you comply with them. You shall have no right to bring any claim against us in respect of refusal to register a domain name. Any administration charge paid by you to us shall be non-refundable notwithstanding refusal by the naming authority to register your desired name.

2.3 We shall have no liability in respect of the use by you of any domain name. Any dispute between you and any other person must be resolved between the parties concerned in such dispute. If any such dispute arises, we shall be entitled, at our discretion and without giving any reason, to withhold, suspend or cancel the domain name. We shall also be entitled to make representations to the relevant naming authority but will not be obliged to take part in any such dispute.

2.4 We shall not release any domain to another provider unless full payment for that domain has been received by us.

2.5 Your registration payment includes the first 2 years annual fees, any additional annual fees are paid 2 years in advance and must be received by us by the date specified on your reminder invoice to guarantee continued registration and use of your domain name. Invoice payment date will be 21 days prior to payment date required by our Server to ensure continued Service.

2.6 We are not liable for loss of a domain name due to late payments to ourselves.

3. WEB SITE HOSTING BY FDESIGN-NET

3.1 We make no guarantee of the availability of the service provided by our Server. We will however follow up on any service issues you have with our Server with respect to access to your Web Site. We are not liable for any financial loss to you as a result of this Service.

3.2 We will keep backup copies of your web pages, which will be downloaded free of charge, in the event of loss of information from your Web Site due to our Server.

3.3 We are bound by the ACCEPTABLE USAGE POLICY of our Server, which will be considered when designing and setting up your web pages.

3.4 If you pay monthly for this service payment must be received by the date specified in section 5.4 or we shall be entitled to block your Web Site, without notice, until payment is made.

3.5 If you pay yearly for this service you will be invoiced 4 weeks prior to the date specified in section 5.2 as a prompt for payment. If payment is not received by the date agreed then we shall be entitled to block your Web Site, without notice, until payment is made.

3.6 An administration charge of £10 will be made for releasing a blocked Web Site.

3.7 If you wish to terminate you web hosting no less than a months notice should be given any advance payments are non-refundable.

3.8 If you wish to have your site transferred to another Server this can be arranged with us but an administration charge will apply payable prior to transfer. (Current administration charge £30). Alternatively, where possible, a disk copy of your site can be obtained for £20 payable before release of the disk(s). Changes to this cost will be notified via our web site only.

4. UPDATE OF INFORMATION

4.1 A current list of update prices can be found on the "Web design information" section on our web site "fdesign" using the link from www.fdesign-net.co.uk. (Brief overview can be found on your quote form as well).

4.2 Update prices can change at any time without prior notice however any quotes given on old prices will be honoured up to a month from quotation date.

4.3 All update payments must be received prior to the update going live.

5. ONGOING PAYMENT DETAILS

5.1 Your site was release on ..........(date). All yearly and monthly hosting fees will be based on this date.

5.2 Your yearly hosting fee, if applicable, will be invoiced 4 weeks prior to ...........(date), each year, whilst you are still using our services.

5.3 Your yearly hosting fee is currently .........(£sterling). Any changes to this will be notified by post for you to decide if you want to continue or terminate your service at the end of your year (see section 3.7 and 3.8 for details on web hosting termination)

5.4 If you have agreed another option for hosting payments, details are as follows. You have agreed to pay every ……… month(s). Payments of …………… must be received by the …………………… (date) every ………… month(s). The first being ………………… (date). Any changes to this will be notified by post for you to decide if you want to continue or terminate your service at the end of your year (see section 3.7 and 3.8 for details on web hosting termination)

5.5 These payments only include hosting and not updates, which are detailed in section 4.0.
